Arbitration allows parties to conduct mini, informal trials that can
be considerably less expensive than a full courtroom presentation.
In the event mediation fails, and court conducted settlement
conferences don’t do the trick, arbitration is a viable, less
expensive alternative.
The parties can agree to make the arbitration
binding, in which case it is generally a final determination, or
non-binding, which means a party can elect to reject the finding and
ask for a trial. The hearing is usually presided over by one, or as
many as three arbitrators, usually retired judges, or experienced
attorneys.
