More than 90 percent of disputes that result in lawsuits are resolved without the ultimate confrontation and expense of a formal trial. By far the most effective method of avoiding the escalating cost -- both monetary and emotional -- of formal litigation, and the courtroom, is a process called mediation. Very few people want their differences aired publicly. Being able to bring adverse parties to the table, working through surface issues to the real controversies, allowing a forum for expressing and venting by all sides, and reaching closure where dignity and principle are maintained, is an art reserved to those with sufficient experience and the appropriate temperment.
