| MEDIATION
Mediation provides the next logical step in devising an effective
conflict resolution forum. Rather than the win or lose concept of a
full-fledged courtroom battle, the parties, with the aid and nudging
of a third person referee, trained in the art of negotiation and
compromise, put forth their claims and positions in the less formal
setting of a conference room.
Over 90 percent
of disputes that result in lawsuits are resolved without the
ultimate confrontation and expense of a formal trial. By far the
most effective method of avoiding the escalating cost of formal
litigation - both monetary and emotional - and the courtroom, is
this process called mediation. Very few people want their
differences aired publicly. Mediation allows adverse parties to come
to the table, work through surface issues to the real controversies,
and provides a forum for expressing and venting by all sides.
Closure can be reached with dignity and principle.
The process is
quicker, more efficient and less expensive. It can be instituted
without the need for filing a formal lawsuit. It does, first and
foremost, require the good faith participation of the feuding
parties.
Over the last three decades, I have participated in many
mediated disputes both as an advocate and as a mediator. I have
served as both a settlement judge and a pro-tem trial judge in the
California Superior Courts. At present, I am offering my services as
a mediator in disputes involving business transactions, insurance
claims, and general civil matters, including marital and estate
disputes.
Fees for my
services are available upon request, and depend on the complexity of
the issues, as well as the number of parties involved.
